A Bill to Enforce the SRTV Charter and Rules and Regulations
WHEREAS, Steven W. York is defined as a "producer" by Article C, Section 2 of the Charter of SRTV, a service of the Associated Students, and;
WHEREAS, the abovementioned article of the SRTV Charter states that producers are "held responsible for their own actions," and;
WHEREAS, Steven W. York, Stevie Why Productions, and Koala TV produced and broadcasted a graphic depiction of sexual activity involving nudity on October 27, 2005 in violation of the SRTV Charter and Rules and Regulations, and;
WHEREAS, the A.S. Council is entitled to resolve non-compliance with the SRTV Charter and Rules and Regulations, and;
WHEREAS, the A.S. Council administers SRTV as a non-public media forum through the implementation of the SRTV Charter and Rules and Regulations, THEN
BE IT ORDERED BY THE COUNCIL OF THE ASSOCIATED STUDENTS OF THE UNIVERSITY OF CALIFORNIA, SAN DIEGO THAT effective immediately, Steven W. York, Stevie Why Productions, and Koala TV are barred from utilizing in any way or entering the premises of SRTV, a service of the Associated Students, and that productions emanating from these aforementioned groups and people are strictly forbidden to be aired on SRTV, and;
BE IT ALSO ORDERED BY THE COUNCIL THAT the Station Managers of SRTV shall actively enforce this order of the Council consistent with their managerial responsibilities laid out in the SRTV Charter and Rules and Regulations, and;
BE IT FINALLY ORDERED BY THE COUNCIL THAT the Commissioner of Student Services shall hold the ultimate authority to enforce this order and shall also have as his or her discretion all appropriate means and resources to enforce this order.

WHEREAS, Steven W. York has admitted that he violated these sections through his admission of engaging in civil disobedience, and;
WHEREAS, the A.S. Council administers SRTV as a non-public media forum through the implementation of the SRTV Charter and Rules and Regulations, THEN
BE IT ORDERED BY THE COUNCIL OF THE ASSOCIATED STUDENTS OF THE UNIVERSITY OF CALIFORNIA, SAN DIEGO THAT effective immediately, Steven W. York, Stevie Y. Resolution upholding the Governance Documents of ASUCSD and the ASUCSD commitment to a respectful community
WHEREAS, the Associated Students of the University of California, San Diego (ASUCSD), aims to provide educational, social and community building, activities, resources, and opportunities for the undergraduate student community; and,
WHEREAS, ASUCSD has often reaffirmed its commitment to a diverse, thoughtful, just, understanding, tolerant, and respectful community at UCSD; and,
WHEREAS, ASUCSD has charted several services and commissions to enhance the UCSD community; and,
WHEREAS, one such ASUCSD service is Student Run Television (SRTV); and,
WHEREAS, SRTV has been the subject of controversy for several months with regard to programming known as “Koala TV;” and,
WHEREAS, in response to the showing of inappropriate material on SRTV, in the form of hardcore amateur pornography, the ASUCSD Council adopted an amendment to the SRTV charter in a special meeting on Sunday, October 23, 2005 that limited “graphic depictions of sexual activity involving nudity;” and,
WHEREAS, the Council reconsidered and reaffirmed this amendment in its regularly scheduled meeting on Wednesday, October 26, 2005; and,
WHEREAS, communications sent after the passage and reaffirmation of this amendment from the Commission of Student Services to the station managers of SRTV convey the expectation of full compliance with this charter amendment; and,
WHEREAS, in a Thursday, October 27, 2005 broadcast of “Koala TV” on SRTV, there were “graphical depictions of sexual activity involving nudity” and the defamation of a current UCSD student and ASUCSD Council member.
THEREFORE, BE IT RESOLVED, that the ASUCSD remains committed to building a strong educational, social, active and diverse community for undergraduate UCSD students; and,
BE IT FURTHER RESOLVED, that the ASUCSD reaffirms its commitment to the UCSD Principles of Community and expects the council, its commissions, and its services to act in accordance to these principles; and,
BE IT FURTHER RESOLVED, that the ASUCSD council is disheartened, concerned and frustrated by the disregard of the SRTV charter and the flagrant disrespect found in the Thursday, October 27, 2005 broadcast of “Koala TV;” and,
BE IT FURTHER RESOLVED, that the ASUCSD council is committed to upholding its governance documents; and,
BE IT FINALLY RESOLVED, that the ASUCSD hereby censures SRTV and condemns the Thursday, October 27, 2005 broadcast of “Koala TV.” This broadcast was disrespectful, inappropriate, unnecessary, intentionally malicious, divisive and hurtful. It in no way upholds the ASUCSD commitment to the UCSD Principles of Community or furthers the intent of the ASUCSD or its service, SRTV.

SRTV Resolution to read as follows:
WHEREAS, ASUCSD feels that SRTV is a valuable service to the students of the UC San Diego,
WHERAS, further broadcast, similar to the broadcast at 11:00 PM on Thursday, Oct. 20, 2005, are illegal and leave SRTV, ASUCSD, the University of California, San Diego and the University of California open to legal recourse,
WHEREAS, ASUCSD supports students’ freedom of speech rights,
WHEREAS, unscreened programs are vulnerable to violating local, state and federal laws,
THEREFORE BE IT RESOLVED that SRTV will move to limited operations effective immediately. This will limit the operations of SRTV specifically to pre-screened programs. Furthermore, this will limit all live programs from being aired. Also, during the period of limited operations, SRTV will not offer online streaming of SRTV. SRTV will return to normal operations once an agreement has been signed between the Associated Students and SRTV.
FURTHER BE IT RESOLVED that the Associated Students and SRTV will meet in a timely manner in order to amend the existing SRTV charter in order to prevent similar events from occurring.
FURTHER BE IT RESOLVED that the aforementioned meeting will take place with lawyers from both the Campus Counsel and SRTV present.

Resolution supporting sexual-health safety in depictions of sexual acts at UCSD
WHEREAS, according to the Centers for Disease Control and Prevention, at least half of all new HIV infections in the United States are among people under age 25, and the majority of young people are infected sexually; and,
WHEREAS, Stevie Why Productions and its films may be influential to UCSD students;
THEREFORE BE IT RESOLVED that ASUCSD condemns Stevie Why Productions for not using prophylactics during the production of Rising Fee’s and Poppin’ B’s [sic]; and,
BE IT FINALLY RESOLVED that ASUCSD strongly encourages the use of appropriate prophylactics in future depictions of sexual acts for a UCSD audience.
